An ordinance amending the annexation legal description associated with the

Guckenberg-Bogachiel Way Annexation



WHEREAS, the annexation was enacted by the Council in Ord. No. 518 earlier this year; and



WHEREAS, the information was forwarded to the state for analysis and recording; and,



WHEREAS, the state discovered an error in the legal description; and



WHEREAS, the error excluded a property that was intended to be within the legal description;



THEREFORE, The City Council of the City of Forks do ordain as follows:



Section 1.  The legal description for the Guckenberg-Bogachiel Way Annexation as found in Ord. No. 518 is hereby amended in the manner noted below:



These portions of the East ½ of the NW ¼ of the SE ¼ of Section 8, Township 28N, Range 13W,  W.M.   North of the South boundary of Bogachiel Way not currently within the boundary of the City of Forks, Washington except tax parcel #13280842-275.



Those portions of the SW ¼ of the SE ¼ of Section 9 8, Township 28N, Range 13W, W.M.  starting at a point 592’ East of the NW corner then South along the East West boundary of tax parcel # 13280843-275 a distance of 367’ to the North right of way (ROW)  boundary of Bogachiel Way; then SW along the North ROW boundary of Bogachiel Way a distance of 128.75’ to a point on said boundary directly North of the East boundary of tax parcel # 13280843-100; then South across Bogachiel Way and along the West boundary of tax parcel # 13280843-100 and tax parcel # 1328084375 for a distance of approximately 377.5’ to its intersection with the North boundary of tax parcel # 13280843-225, then East along the Southern boundary of tax lot #’s 1328084375 and 1328084325 a distance of 277’ to the East boundary of the Cook Road ROW; then North 552’ to the Southern boundary of the Bogachiel Way ROW; then NE 449.85’ along the Southern boundary of the Bogachiel Way ROW to it’s intersection with the North boundary of the SW ¼ of the SE ¼ of Section 8, Township 28N, Range 13 E W.M. then West along said Northern boundary to the part of beginning.



Section 2.  Effective Date.  This ordinance shall take effect five days after the publication of this ordinance within the Forks Forum.
