Ordinance No. 531

An ordinance amending the Forks Zoning Code to simplify the process of

Permitting residential duplexes, tri-plexes and four-plexes



WHEREAS, the City of Forks adopted its first zoning code in 1997;



WHEREAS, the code’s land use matrix defined various residential uses and established permitting procedures for multifamily residential uses but did not truly distinguish between the type or land use permit needed for a duplex or a 16+ unit apartment complex;



WHEREAS, the Planning Commission agreed to review this issue as a result of a request for a rezone that was heard by the Commission as part of its 2004 GMA updates;



WHEREAS, the Commission discussed the issue at its February 2005 meeting and again at its March 2005 meeting, and determined by consensus vote that the Zoning Code be changed in the manner reflected below;



WHEREAS, the City Council held a hearing on this recommendation of the Planning Commission; and



THEREFORE, THE CITY COUNCIL OF THE CITY OF FORKS DO ORDAINS AS FOLLOWS:



Section 1. Amending FMC 17.15.060.  FMC 17.15.060 is amended in the manner noted in the attached table with the underlined text replacing the strikethrough text.



Section 2.    Adoption of Amendments not incompatible with Comprehensive Plan.  The Council’s adoption of these amendments is an affirmation of the recommendation of the Planning Commission; and the Council, by adoption of this ordinance, further determines that this amendment is not incompatible with the Comprehensive Plan but rather a clarification of the existing zoning code.
